This DMCA Policy describes how Txaion handles copyright complaints under the U.S. Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. Section 512. This policy is incorporated into the Terms of Service.
1. Designated Agent
DMCA notices may be sent to:
Txaion DMCA Agent
Txaion LLC
30 N Gould St Ste N
Sheridan, WY 82801
United States
Email: [email protected]
Phone: +1 628 213 8851
U.S. Copyright Office DMCA Designated Agent Registration Number: DMCA-1072819
Txaion maintains public DMCA agent contact information on this page and, where required for DMCA safe harbor eligibility, in the U.S. Copyright Office's online designated agent directory. Website notice alone may not be sufficient for DMCA safe harbor eligibility. Txaion is responsible for keeping any Copyright Office designation current, including renewals required by the Copyright Office, which generally must be renewed at least every three years. Txaion may update this contact information from time to time.
2. Copyright Infringement Notices
If you believe content available through the Services infringes your copyright, send a written notice to the DMCA Agent that includes:
- Your physical or electronic signature
- Identification of the copyrighted work claimed to be infringed, or a representative list if multiple works are involved
- Identification of the allegedly infringing material and information reasonably sufficient for Txaion to locate it, such as URLs, account identifiers, file names, prompt or output IDs, timestamps, or screenshots
- Your name, mailing address, telephone number, and email address
- A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act for the owner
Incomplete notices may delay processing.
3. Takedown Process
Upon receipt of a substantially compliant notice, Txaion may remove or disable access to the material, notify the user who posted or stored the material, terminate repeat infringers, and take other actions required or permitted by law. Txaion may also preserve relevant records, account information, logs, notices, counter-notifications, and related communications as reasonably necessary to administer this policy, comply with law, enforce the Terms, prevent abuse, or resolve disputes.
Txaion may forward the notice, including your contact information, to the user who provided the material or to other parties as needed to process the complaint.
4. Counter-Notifications
If you believe your material was removed or disabled by mistake or misidentification, you may send a written counter-notification to the DMCA Agent that includes:
- Your physical or electronic signature
- Identification of the material removed or disabled and the location where it appeared before removal or disabling
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled because of mistake or misidentification
- Your name, mailing address, telephone number, and email address
- A statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is located, or if your address is outside the United States, the federal district court for any judicial district in which Txaion may be found
- A statement that you will accept service of process from the person who submitted the original notice or that person's agent
If Txaion receives a valid counter-notification, Txaion may forward it to the original complainant. Txaion may restore the material in accordance with the DMCA, generally not earlier than 10 business days and not later than 14 business days after forwarding the counter-notification, unless the original complainant files a court action seeking to restrain the user from engaging in infringing activity and notifies Txaion as required by the DMCA.
5. Repeat Infringer Policy
Txaion will, in appropriate circumstances, terminate or restrict accounts of users who are repeat infringers or who repeatedly submit infringing content. Txaion may also terminate accounts involved in serious infringement, fraudulent notices, or abuse of the DMCA process.
Txaion may consider relevant circumstances when applying this policy, including the number, severity, validity, and timing of notices, counter-notifications, account history, and evidence of bad-faith or abusive notices.
Txaion may maintain internal records of copyright notices, counter-notifications, removals, restorations, repeat-infringer determinations, and related account actions to help apply this policy consistently. Txaion is not required to adjudicate copyright ownership, fair use, licenses, or other complex disputes beyond the notice-and-takedown process required or permitted by law.
6. Misrepresentations
Submitting a false or misleading DMCA notice or counter-notification may result in legal liability. If you are unsure whether material is infringing, consult an attorney before submitting a notice.
7. Trademark and Other IP Complaints
This DMCA Policy applies to copyright. Trademark, publicity rights, trade secret, or other intellectual property complaints may be sent to [email protected] with enough information for Txaion to investigate.
8. No Legal Advice
This policy is provided for operational notice-and-takedown purposes and is not legal advice.
