This Biometric, Voice, Likeness, and Digital Twin Consent Notice ("Consent Notice") applies when Txaion presents this Consent Notice, when a feature requires separate consent or authorization, or when Txaion processes biometric-related data, voice data, likeness materials, personality simulation materials, avatar materials, or digital twin materials in connection with the Services. This Consent Notice supplements the Terms of Service, Privacy Policy, AI Policy, and Data Processing Addendum, where applicable.
This Consent Notice is not legal advice to Customers. If you use the Services to collect, upload, generate, or process another person's voice, likeness, biometric-related data, private information, or digital twin materials, you are responsible for determining and satisfying the consent, notice, retention, deletion, employment, publicity, privacy, consumer protection, and data protection laws that apply to your use case.
1. Data Covered
Depending on the feature, covered data may include:
- Audio recordings, speech samples, transcripts, voiceprints, voice embeddings, speaker characteristics, pronunciation patterns, and voice model settings
- Images, videos, likeness materials, face geometry, avatar inputs, appearance settings, and synthetic media outputs
- Personality, memory, preference, conversation, style, behavioral, or profile materials used to simulate or personalize an AI agent, avatar, persona, or digital twin
- Prompts, instructions, metadata, consent records, authorization records, verification records, usage logs, and related technical data
Some covered data may be considered biometric information, sensitive personal data, personal information, publicity-rights material, or confidential information under applicable law depending on how it is collected, used, stored, or linked to a person.
2. Purposes
Txaion may process covered data to:
- Provide, generate, personalize, operate, secure, and improve the relevant feature
- Create, configure, test, maintain, or delete voice, likeness, avatar, memory, persona, or digital twin functionality
- Verify authorization, prevent abuse, detect impersonation, enforce policies, and protect users or the public
- Provide support, troubleshoot issues, investigate security incidents, comply with law, and resolve disputes
- Maintain records reasonably necessary to demonstrate consent, authorization, revocation, deletion, security, compliance, or policy enforcement
Txaion does not use Customer Content to train, fine-tune, or improve third-party foundation models or Txaion general-purpose AI models unless expressly authorized as described in the Terms, Privacy Policy, AI Policy, and DPA.
3. Consent and Authority
By using a feature covered by this Consent Notice, you represent that:
- You are the person whose covered data is being processed, or you have valid authorization from that person or the legally appropriate rights holder
- You have provided all required notices and obtained all required consents, releases, permissions, and lawful bases before submitting covered data
- You have authority to use the source recordings, images, videos, files, memories, profiles, prompts, and other materials you provide
- You will not use the Services to impersonate, deceive, defraud, harass, exploit, or mislead any person
- You will honor revocation, withdrawal, deletion, opt-out, and objection rights where required by law, contract, or product settings
For minors, employees, contractors, deceased persons, public figures, vulnerable persons, patients, students, or people in sensitive contexts, you must obtain authorization from the legally appropriate person or rights holder and comply with any additional legal requirements.
4. Customer-Controlled Use
If you are a Customer using the Services to process covered data about your users, employees, contractors, customers, end users, or other third parties, you are responsible for:
- Providing your own legally sufficient notices and terms
- Obtaining and maintaining consent, authorization, release, and withdrawal records
- Setting and enforcing lawful retention and deletion rules for your use case
- Responding to rights requests and revocations where you control the data
- Flowing down applicable restrictions to your users and administrators
- Ensuring your product, workflow, bot, agent, integration, or digital twin complies with applicable law
Txaion may request evidence of authorization or compliance and may suspend, restrict, or delete covered data or related functionality if authorization is missing, withdrawn, disputed, or legally insufficient.
5. Retention and Deletion
Retention depends on the feature, product settings, Customer instructions, consent status, account status, legal requirements, security needs, backups, and contractual commitments.
Unless a product-specific notice, signed agreement, or legally required retention schedule states otherwise, Txaion retains covered data only as long as reasonably necessary for the purposes described in this Consent Notice, the Privacy Policy, the DPA, and the applicable feature. Txaion will delete or de-identify covered data when it is no longer needed for those purposes, when deletion is required by applicable law, or when a valid deletion or withdrawal request requires deletion, subject to legal holds, disputes, security investigations, fraud prevention, compliance obligations, backups, and technically necessary retention.
Data retained in backups, logs, or temporary storage may persist for a limited period before being overwritten or deleted according to backup and retention cycles, unless legal, security, or compliance obligations require longer retention.
6. Withdrawal and Revocation
Where applicable law, contract, or product settings give you a right to withdraw consent or revoke authorization, you may do so through available product controls or by contacting [email protected]. Withdrawal or revocation may limit or disable the relevant feature and may require deletion or disabling of related covered data, models, outputs, or digital twin materials.
If you are a Customer and receive a withdrawal, revocation, deletion, or objection request relating to covered data you control, you are responsible for promptly taking all actions required by law and for instructing Txaion where Txaion acts as your processor or service provider.
7. Disclosure and Subprocessors
Txaion may disclose covered data to subprocessors, service providers, contractors, professional advisors, affiliates, and other parties as described in the Privacy Policy, DPA, and Subprocessor List. Feature-optional AI, speech, media, identity, storage, security, support, and infrastructure providers may process covered data only when the relevant feature or operational need applies.
Txaion may also disclose covered data where required by law, legal process, valid government request, rights request, safety concern, abuse investigation, or enforcement of the Terms, AUP, AI Policy, or this Consent Notice.
8. Restrictions
You may not use covered data or related features to:
- Create unauthorized voice clones, likeness simulations, avatars, personality replicas, or digital twins
- Create deceptive, non-consensual, exploitative, intimate, abusive, or unlawful synthetic media
- Present synthetic media as a real endorsement, real event, official statement, professional advice, identity verification, evidence, record, or human communication when that presentation is false, misleading, or unlawful
- Use covered data for unlawful surveillance, biometric identification, emotion recognition, sensitive profiling, discrimination, harassment, fraud, employment decisions, credit, housing, insurance, healthcare, legal rights, education, public benefits, law enforcement, or other high-impact decisions without required legal safeguards
- Remove or misrepresent labels, watermarks, provenance signals, consent records, disclosures, or authorization evidence
Additional restrictions appear in the Acceptable Use Policy and AI Policy.
